At AKB Enterprise Group Pty Ltd, Trading as Pro Speed Racing (“Pro Speed Racing”, “we”, “our”, “us”), we are committed to complying with the Australian Consumer Law (“ACL”) and providing fair outcomes for our customers.
Nothing in this policy excludes, restricts or modifies any rights or remedies you may have under the Competition and Consumer Act 2010 (Cth), including the consumer guarantees under the Australian Consumer Law.
1. Change of Mind Returns
Subject to the conditions below, Pro Speed Racing may accept returns for change of mind purchases at our discretion.
Eligible Items
Items may be eligible for return where:
- the item is unused, uninstalled, unmodified and in brand new condition;
- the item is returned in its original packaging;
- the packaging is undamaged and suitable for resale;
- the item is not a special-order, made-to-order, customised or imported-on-request product; and
- a return request is lodged within fourteen (14) days of delivery.
Non-Returnable Items
The following items are generally not eligible for return unless required under Australian Consumer Law:
- special-order or non-stocked items;
- overseas indent or imported-on-request items;
- electrical items that have been installed or connected;
- items that have been test fitted, installed, modified, painted, tuned, used or damaged after delivery;
- clearance, discontinued or final-sale items;
- customised or made-to-order products.
Approval of any return remains at the discretion of Pro Speed Racing.
2. Return Process
To request a return, customers must contact us within fourteen (14) days of receiving the order.
If approved:
- an RMA (Return Merchandise Authorisation) number will be issued; and
- the goods must be returned within seven (7) days of approval unless otherwise agreed in writing.
Returns sent without an approved RMA may be refused.
3. Restocking Fees
Approved change-of-mind returns may incur a restocking fee to cover handling, administration, repackaging and supplier charges.
The following fees may apply:
- Standard stocked items: up to 15% of the purchase price;
- Special-order or non-stock items: up to 20% of the purchase price.
Where an item is returned in a condition other than original brand-new condition, additional repackaging or refurbishment charges may apply, or the return may be rejected.
If a return is rejected, the item may be returned to the customer at the customer’s expense.
At our discretion, Pro Speed Racing may offer a store credit instead of a refund.
4. Refunds
Approved refunds will be processed back to the original payment method where possible.
For change-of-mind returns:
- original shipping charges are non-refundable;
- payment gateway or merchant processing fees charged to Pro Speed Racing by third-party providers (including but not limited to PayPal, Afterpay, Zip, Klarna or Shopify Payments) may be deducted where permitted by law and where those fees are not refunded to us by the payment provider.
Refund processing times may vary depending on the payment provider or financial institution.
5. Return Shipping
Unless the return relates to a major failure, incorrect item supplied, faulty product, or another remedy required under Australian Consumer Law:
- customers are responsible for all return shipping costs;
- customers are responsible for ensuring goods are adequately packaged for transport;
- we strongly recommend using tracked and insured freight services.
If Pro Speed Racing supplied the incorrect item or the item has a confirmed fault covered under ACL obligations, Pro Speed Racing will arrange or reimburse reasonable return freight costs.
6. Faulty, Damaged or Incorrect Items
Under Australian Consumer Law, customers are entitled to remedies for products that:
- are faulty;
- are not of acceptable quality;
- are not fit for purpose;
- do not match the description or sample shown; or
- were incorrectly supplied.
Where required under Australian Consumer Law, Pro Speed Racing will provide an appropriate remedy, which may include:
- repair;
- replacement;
- refund; or
- store credit where agreed.
We may request photos, testing information or return of the product for assessment prior to determining the appropriate remedy.
7. Product Fitment & Customer Responsibility
Customers are responsible for ensuring products are suitable for their intended vehicle application before installation.
Where products are ordered based on incorrect information supplied by the customer, or where compatibility was not verified prior to purchase, returns may be refused or subject to restocking fees.
Professional installation is strongly recommended for all performance and automotive components.
8. Limitation of Liability
To the maximum extent permitted by law, Pro Speed Racing will not be liable for:
- labour or installation costs;
- vehicle hire costs;
- towing expenses;
- loss of income;
- loss of use;
- consequential or indirect loss; or
- any additional costs arising from the use, delay, failure or incorrect installation of products supplied.
Nothing in this clause excludes liability that cannot legally be excluded under Australian Consumer Law.
